The customer must always read the general terms and conditions for distance selling before placing an order. Placing an order via the website or by phone constitutes express acceptance of the general terms and conditions for distance selling.

2. Acceptance of These Terms and Conditions
Only these current terms and conditions apply to distance sales (via the internet or telephone) by 99 PERFORMANCE to end-users within Belgium. Any other conditions, even those listed on the buyer's order form, are excluded. 99 PERFORMANCE reserves the right to amend these general terms and conditions at any time. However, ongoing contracts remain subject to the terms and conditions that were in force at the time the sale was concluded. Where specified, certain provisions apply only to purchases by a "consumer," defined as any natural person acting for purposes outside their trade, business, craft, or profession.
3. Conclusion of Distance Sale
To reserve or order a product online, the customer must add the product to their shopping cart, select the quantity, provide their customer details, and choose a payment method (see Article 6). To complete the reservation or order, the customer must press the "proceed to payment" button and make the payment. Once the confirmation email is received, the purchase is complete.
99 PERFORMANCE reserves the right to request additional information for the safety and security of the customer and may refuse to process an order if such information is not provided. Orders from minors or orders indicating an intent to resell products may also be refused. Similarly, 99 PERFORMANCE may cancel an order if an evident mistake is found in the product description or pricing on the website, despite the company's meticulous attention to accuracy. In cases of force majeure, 99 PERFORMANCE may suspend its obligations for the duration of the force majeure or terminate the agreement altogether.
4. Transfer of Ownership
Contrary to Article 1583 of the Civil Code, all sold, delivered, or installed goods remain our exclusive property until the invoice is fully paid. Despite this retention of ownership, the risk of loss or damage passes to the customer upon receipt of the goods.
5. Prices
All goods are inclusive of VAT. Offers remain valid as long as they are listed on the website. Prices are subject to change at any time. For distance sales, the price applicable at the time of the order will apply.
6. Payment
Customers can select an option online and proceed to payment via Bancontact or Mastercard. Cash payments on-site are also possible.
7. Right of Withdrawal
Within 14 days after 99 PERFORMANCE is notified of the decision to withdraw, all amounts paid will be refunded in the form of a voucher/credits. No cash refunds will be provided to the player/parent/guardian.
8. Intellectual Property Rights
99 PERFORMANCE retains ownership of all intellectual property rights (copyrights, trademarks, designs, models, etc.) related to their services or products, as well as the content of the website, including information, photos, and videos. Any reproduction, publication, distribution to third parties, or other use of 99 PERFORMANCE's intellectual property is prohibited without prior written consent from the founder.
9. Personal Data
9.1. By purchasing products/services on the 99 PERFORMANCE website, the buyer agrees that their personal data (name, address, phone number, email address, and additional information such as team, birth date, and clothing size) will be stored and processed by 99 PERFORMANCE.
9.2. 99 PERFORMANCE will use this data solely to process the customer's order.
9.3. In accordance with the law, customers have the right to access, correct, or delete their personal data stored by 99 PERFORMANCE. Such requests must be sent to info@99performance.com.
9.4. Changes to this privacy statement: We reserve the right to modify our privacy policy. Regularly reviewing the policy is recommended to stay informed about updates.
10. Risks and Liability
10.1. Neither 99 PERFORMANCE nor its staff can be held liable for death, personal injury, or illness affecting members, their children, or guests at the club's premises, except in cases of intentional misconduct or gross negligence by 99 PERFORMANCE staff. Use of equipment, participation in programs, or any activities is entirely at the member's own risk.
10.2. Neither 99 PERFORMANCE nor its staff can be held liable for the loss, damage, or theft of goods at the training location, except in cases of intentional misconduct or gross negligence.
10.3. The customer is responsible for any damage caused to the property of 99 PERFORMANCE or its representatives.
11. Medical Condition
11.1. The customer declares they are in good health, with no medical or other conditions preventing participation in physical activities. Engaging in physical activity will not harm their health, safety, or physical condition.
11.2. Customers must not participate in 99 PERFORMANCE training if they have an infection, contagious disease, or injuries (e.g., open wounds) that could harm the health, safety, or physical condition of others.
12. Use of Visual Material
Photos and videos may be taken during 99 PERFORMANCE activities. These may be used for promotional purposes or to inform parents and participants about 99 PERFORMANCE and its activities. By agreeing to these terms and conditions, you consent to 99 PERFORMANCE using such materials for:
- Brochures, flyers, and similar materials
- The 99 PERFORMANCE website
- Social media accounts (Instagram, YouTube)
This consent can be withdrawn at any time by submitting a signed and dated written declaration to 99 PERFORMANCE.
